Ernakulam Commission Orders Refund to Consumer in Home Elevator Dispute

The District Consumer Disputes Redressal Commission (DCDRC) in Ernakulam ruled that Nibav Lifts was responsible for deficiency in services and unfair trade practice regarding a home elevator installation. The commission ordered Nibav Lifts to refund ₹2.69 lakh with interest to Justice (Retd) TR Ramachandran Nair and his wife. The ruling stated that the company failed to properly analyze the feasibility of installing the lift at the complainants' residence before accepting the advance payment.

The ruling highlights the responsibility of companies to possess the technical expertise to evaluate installation sites and explain the implications of such equipment. The commission emphasized that consumers should not be expected to possess the technical knowledge required to evaluate these consequences.
