Farm Owner Sues State Health Department Over Food Service Regulatory Gray Areas

Ian Newell, a farm owner operating in Henrico and Richmond, has filed a lawsuit against the Virginia Department of Health. The suit concerns regulatory issues encountered while operating food service businesses, including Celeste Farms and Goatacado. Newell claims he relied on existing catering and food-truck permits for services provided on private property. The department stated that the operation eventually expanded beyond what those initial permits allowed.

The suit focuses on whether the department adequately guided Newell through the necessary process of obtaining a food-establishment permit as his operations expanded. The department acknowledged it had advised Newell several times regarding the need for a food-establishment permit.
