Coalition of Attorneys General Opposes Proposed Fee on H-1B Visa Petitions

A coalition comprising 22 U.S. Attorneys General has formally opposed a proposal by the Trump administration regarding fees on H-1B visa petitions. The coalition argues that the proposal, which would impose a charge of $103,265 on certain petitions, is unlawful and constitutes a tax without Congressional authorization. Jay Jones, the Attorney General of Virginia, joined the coalition to formally object to the rule.

The attorneys general contend that the administration exceeded its authority under the Immigration and Nationality Act and failed to justify the burden the charge would place on states. The coalition also stated that the administration did not adequately consider less damaging alternatives to the proposed fee.
